The Malamud case C-588/21P – regulation 1049/2001
The 4 toy standards from CEN, subject of the European Court of Justice (ECJ) judgment in Case C-588/21 P concerning public access to four Harmonized Standards under Regulation 1049/2001, are now available in read-only access.
CEN-CENELEC members have developed a decentralized application centrally accessible via https://has.standards.eu/. This site redirects to national websites where the standards can be consulted in the national languages. In view of the outsourcing of the sales to NBN, it is https://app.nbn.be/data/r/platform/public-portal/home for Belgium.
The EC asks to add a second batch of standards by 28/09/2024. Unlike the first set that only contained European standards, this set also contains EN ISO and EN IEC standards. CEN and CENELEC with the EC are trying to find a solution for making the ISO and IEC content available respecting all applicable copyrights.
With this decentralized solution, the national committees stay in contact with the standard users and can invite them to get more involved in standardization by contributing to the standards development or by also buying other products.
